Final Cmv Drug and Alcohol Clearinghouse Rule Released

A Federal Motor Carrier and Safety Administration (FMCSA) final rule on employer use of a Commercial Driver’s License Drug and Alcohol Clearinghouse is scheduled to be published in the Federal Register on Dec. 5 and will take effect 30 days later.

The clearinghouse will serve as a central data repository for all drug- and alcohol-related program violations. Employers will be required to query the system to determine whether current or prospective employees have incurred a drug- or alcohol-related violation that would prohibit them from performing safety-sensitive duties.

Employers, medical review officers (MROs) and their representatives are required to report information about positive drug test results, alcohol test results greater than 0.04 blood-alcohol content, refusals to test and other non-test violations of the FMCSA’s drug and alcohol regulations.
